Omni Bridgeway
The Services
Collective Redress / Multiple Party Claims
Where many individuals or companies have worthwhile claims arising from similar circumstances, Omni Bridgeway funds, manages and administers those claims as part of a single project.
Bundling many claims together into a single process generates economies of scale which minimise expense and thereby maximise recovery. Omni Bridgeway has international experience and networks in this type of major litigation.
Again, this service facilitates access to justice which might otherwise have been unattainable due to practical impediments such as costs, risks and lack of familiarity with claim processes
Typical collective redress claims include:
- Cartel damages claims If an industry monopoly engages in price-fixing its customers have suffered losses from paying inflated prices. Customers often include medium to large enterprises who have individually suffered several million Euros of loss.
- Securities Litigation When a listed company misleads institutional and retail investors, for example by making profit forecasts fraudulently or without reasonable grounds, shareholders can suffer unfair losses. Such misleading and deceptive conduct causes unwarranted wealth reduction and jeopardises the reputation of entire markets. Shareholders losses are often recoverable.
- Any claims which multiple parties have arising from sufficiently similar circumstances. For example, claims against:
- Governments, for improperly expropriating property or livelihood, or unlawfully collecting taxes;
- Financial advisors, by customers;
- Banks or credit card companies for unlawful fees;
- Wholesalers, by groups of retailers; or
- Franchisors or master franchisees, by franchisees.
